These Terms of Service (“Terms”) are a contract between you and Clippable Labs Inc for use of Scanning Cards at https://scanningcards.com and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
The Service
Scanning Cards provides (a) historical sold-price information for graded cards and (b) automated condition and grade estimates from photographs of raw cards. It is a research tool. It is not a grading company, an appraisal, investment advice, or a guarantee of any grade, sale price, or authentication.
Accounts
- You must be at least 18, or the age of majority where you live.
- You are responsible for activity on your account. Keep your Google sign-in secure.
- We may suspend or close accounts that abuse the Service, evade payment, scrape data, or break the law.
Purchases and credits
- Packs are one-time payments processed by Stripe. Prices are shown at checkout and may change for future packs.
- Raw-scan credits are consumed when you run a raw-card analysis. Graded cert lookups included with a pack are unlimited for that account unless we revoke them after a refund or chargeback.
- Packs stack. Credits are not cash, have no residual value, and are not transferable.
- Because digital analysis is delivered immediately, all sales are final except where a refund is required by law or we agree in writing. A full refund revokes remaining credits and unlimited graded lookups.
- You authorize Stripe to charge the payment method you submit. Tax may be added where required.
Your content
You retain rights in photos you upload. You grant Clippable Labs Inc a license to store, process, and display them as needed to provide and improve the Service (including sending them to our analysis providers). You represent that you have the right to upload those photos and that they do not infringe anyone else’s rights.
Acceptable use
You will not:
- Probe, scan, or attack the Service or other users.
- Bypass payment, authentication, rate limits, or credit metering.
- Use automated means to scrape sold-price data or overload the Service.
- Upload malware or content that is illegal, or use estimates to commit fraud.
- Reverse engineer the Service except as allowed by law.
No affiliation
Scanning Cards is not affiliated with, endorsed by, or sponsored by PSA, Beckett / BGS, CGC, SGC, TAG, eBay, or any other grader or marketplace named in the Service. Their names and marks belong to them and are used only to identify the services they operate.
Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. GRADE PREDICTIONS ARE ESTIMATES MADE FROM PHOTOGRAPHS. LIGHTING, ANGLE, GLARE, AND RESOLUTION AFFECT RESULTS. SOLD PRICES ARE HISTORICAL AND ARE NOT A VALUATION OR AN OFFER TO BUY OR SELL. CLIPPABLE LABS INC DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CLIPPABLE LABS INC AND ITS OFFICERS, DIRECTORS, AND EMPLOYEES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CARDS, OR LOST DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM, OR $25 IF YOU HAVE NOT PAID. SOME PLACES DO NOT ALLOW THESE LIMITS; IN THOSE PLACES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT ALLOWED.
Indemnity
You will defend and indemnify Clippable Labs Inc against claims arising from your use of the Service, your content, or your breach of these Terms, except to the extent caused by our willful misconduct.
Changes and termination
We may change the Service or these Terms. Continued use after a posted change means you accept the new Terms. You may stop using the Service at any time. We may stop offering the Service or close accounts with notice where required.
Governing law
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Courts located in California will have exclusive jurisdiction, except that either party may seek injunctive relief in any court for unauthorized access or IP misuse.
